The following food product chain, Wal-Mart, Fresh Quest and all Retailers, suppliers, wholesalers and distributors, who have sold and are selling the contaminated food, Cantaloupe, product, which I ate are responsible for the contaminated cantaloupe, which made me sick and sent me to the Emergency Room. Any and all parties involved in this chain of distribution, the path that their product took from the manufacturer to, distribution to me, the Customers, of the Contaminated Cantaloupe, are responsible for, my Illness.

On April 8, 2016, my daughter, LaJohnda James and I, Brenda Kidd went to Wal-Mart at 5245 Rangeline (service) Road in Mobile, Alabama 36619. There LaJohnda James, purchase 2 cantaloupes for me, Brenda Kidd, along with her groceries. On April 9, 2016, I rinsed both cantaloupes off. Next I cut one of the cantaloupes in half, clean the middle of it out, cut the rind off it and sat it down in a container. Then I sat the other half of the cantaloupe down in another container, instead of setting it down on the countertop. I went on to slice and eat the cantaloupe before cutting the rind off of the other half of the cantaloupe. After I had finished eating the cantaloupe I picked up the other half of the cantaloupe. Just when I was about to clean out the center of the other half of the cantaloupe I didn’t want to believe what I saw. The cantaloupe what I had eaten was contaminated. The cantaloupe was infested with mold, fungus, and mildew substances too me. Or shall I say now, after looking at the outsides of Contaminated Defective Cantaloupes in a Wal-Mart Store it could have been or had to be more than Mold, fungus and mildew substances inside of the Cantaloupe that I ate, which caused my Food Borne Illness. I do have the video along with pictures.

I called my daughter and told her I was sick and explained to her what had happen to me. Sometime after, I called the store and talked to the manager. I told her that I had eaten cantaloupe which had been purchase from her store and it has mold, fungus, and mildew substances in it. I told her that I was sick. She told me to bring the cantaloupes to the store. I told her I could not do anything, I have to wait until my daughter get off from work. She told me, two managers have to see it. She went on to say so you going to have to be here before I get off. When my daughter got off which was shortly after my sickness occurred, we took the cantaloupes to the store along with the Fresh Quest label and showed the contaminated infested cantaloupe to the managers. One of the managers said gross ohhhh. The manager went on to ask, do you have a receipt. The answer was no. However the manager gave us a cash refund back on both, of the two cantaloupes. I told them I don’t know whether I’m going to have to go to the emergency room I’m trying not to go. But if I get anymore sicker I’m going to have to go to the emergency room. I was then told if you think you going to go to the emergency room, or if you are going to the emergency room, you need to fill out a customer incident report. When, I asked how to spell certain words, the manager told me that I do not have to write all of that. All parts of the customer incident report which were not filled out, the manager also stated to Brenda Kidd and LaJohnda James that she did not have to fill them out.

The store manager stated that someone from Wal-Mart will be giving me a call within a few days, usual they are pretty quick about doing that. Well, too me, they were slow, about giving me a call.

After filling out the Wal-Mart incident report we left the store and returned home.

Throughout the night my sickness/symptoms worsen. Overall that night I developed more nausea, vomiting, dizziness, shortness of breath and also stomach pains, diarrhea and headaches, from eating Wal-Mart, as well as, Fresh Quest Cantaloupe. Therefore I had no choice but to go to the Emergency Room. The doctor asked me what happen and I told him after eating a cantaloupe with mold and fungus in it I started to vomit, I got diarrhea, I became nausea, my stomach started to pain, I started to have shortness of breath, I got dizzy and I got a sudden headache. The doctor asked me what I had eaten right before that. My answer was nothing. The doctor immediately told me that he had seen this before. He was sure of my symptoms, which was food poison from the molded cantaloupe. True enough sometime later the doctor came back into the room. It was then that he officially diagnosed me with Foodborne Illness, food poisoning, from the cantaloupe, easy to read. I had to have an IV place in my arm and through it I was given fluids and medication. The doctor stated to me that it is not just going to go away, right away. He said it is going to take days even weeks before the cantaloupe food poisoning and its symptoms completely go away. He said I have to let my sickness from the cantaloupe food poisoning take its course. Also, the doctor told me to return to the Emergency room if symptoms worsen. At some point in between the time that the IV was taken out of me I was given discharge instruction sheets: The sheets stated, Food poisoning, Easy-to-Read I was given patient instructions: Additional Notes which also stated, Food Poisoning, Easy-to-Read Afterwards I was discharged from the emergency room with a prescription for medication and the instructions and the additional notes, paper work. There is a bruise on my left arm from the IV, (slowly fading) which can still be seen close up. It took weeks for me to fully recover from the cantaloupe Food Poisoning, Foodborne Illness.

I, Brenda Kidd received a letter from Wal-Mart CMI, Claims Management, Inc., Respect, Service, Excellence The letter was dated, April 20, 2016. It was mailed out on, April 21, 2016. I received it on, April 25, 2016. It was signed by Angela Bingham, Case Manger III. The letter: RE: Brenda Kidel (she spelled my last name wrong. My last name is Kidd) File#: 7746625 Date of loss 04-09-2016 Store # 866 Dear Ms. Kidel Claims Management, Inc., is the claims handler for Wal-Mart Stores, Inc and for their insurance carrier, regarding customer incidents. I am sorry to hear of your incident with a product purchased at Wal-Mart/Sam’s Club and which was reported to us by the store. I have been unable to reach you by telephone. If you have experienced problems arising from this incident, please let me know by calling 800-527-0566 58011. For some reason, Angela Bingham would not return my calls. So I talked to an operator. I ask the operator to connect me to her supervisor. Angela Bingham supervisor, Jennifer Kappen was very rude and short patience. In between questioning me and getting answers, Jennifer Kappen stated to me there is such a thing, as sight and taste, in a rude tone. What a rude thing to say to a faithful Wal-Mart customer, who was sicken with Foodborne illness by eating there, food product, cantaloupe. This sickness was not my fault. While Jennifer Kappen was looking through my file, she asked, me did I have a receipt? I said no, but when I told her how the cantaloupes were purchase, she told me to go to the store and ask for a receipt of purchase on April 8, 2016, and a UPC number and send it to her. Sometime in between our conversation on the phone I told Jennifer Kappen, I started to contact the FDA. Jennifer Kappen told me that the FDA does not handle cases like this. Jennifer Kappen told me the FDA does not handle fruit cases. And this is a fruit case. Later I found out that was a lie. She went on to say that she was going to contact the person whom I need to talk to right away, and they will be getting in contact with you within 7 days from today. That was a lie just like the first lie Angela Bingham told, when she said in the letter that she was unable to reach me by telephone. She never called me by phone, before the letter was sent out.

Also, According, to Cora Rodriguez, Sol Group Marketing/Fresh Quest, did not hear from Wal-Mart until June 8, 2016.

So, my daughter and I went to the Wal-Mart store where the cantaloupes were purchase to obtain the receipt of purchase, UPC number. After I received the receipt of purchase, which had the UPC number on it, it was even harder to get in contact with Jenifer Kappen, as for Angela Bingham she still would not answer her phone and nor would she return my calls. I Emailed the UPC number 4050KF to Angela Bingham on May 4, 2016 9:25 pm abingha@cmiw.com and on May 9, 2016 6:13 AM I Emailed Angela Bingham several copies of the receipt of purchase. If it wasn’t for the nice man that I talked to, I would not have known that Angela Bingham had received the emails because still, Angela Bingham and Jennifer Pappen would not return my calls. He looked into my file and said yes she has them. Sometime after that, since I did not hear from the person, who Jennifer Kappen said was going to call me, I called her back. I got no responds. However, after that call, Cora Rodriguez called me. I talked to Cora Rodriguez from Sol Group Marketing, whom according to Cora Rodriguez Wal-Mart contacted them on Wednesday, June 8, 2016. She wanted to know why Wal-Mart took so long to contact them. Cora Rodriguez said, two months, I am going to have to call Wal-Mart to see why it took them that long to contact us. Cora Rodriguez said, she was sorry to hear about my incident and that she was going to send me some coupons. I do not want any coupons. I cannot ever eat another cantaloupe. Wal-Mart, Sol Group Marketing and Fresh Quest have deprived me of eating cantaloupe for a lifetime. I was told by Cora Rodriguez that the Fresh Quest, Wal-Mart and Sol Group Marketing Cantaloupes were grown in Honduras or Guatemala. I went on to ask her what about my bill. She said she would have to get back with me on that and that she will have someone else call me about the bill. But I will be calling you back myself, too. Although no one else called me, Cora Rodriguez kept her word. She called me and said they will pay the bill. Then she asked how much is the bill? I told her a little over a thousand dollars. She said yes. Oh yes, we will pay the bill. She told me to send or email her the bill along with the doctor statements and the cantaloupe pictures. Days after I had talked to Cora Rodriguez I, received another letter from Wal-Mart CMI, Claims Management, Inc., Respect, Service, Excellence The letter was dated, June 7, 2016. It was mailed out on, June 7, 2016. I received it on, June 10 or the 11, 2016. It was signed by Angela Bingham, Case Manger III. The letter: RE: Brenda Kidd (she spelled my last name right this time) File#: 7746625 Date of loss 04-09-2016 Store # 866 Dear Brenda Claims Management, Inc. (Claims Management, Inc.) manages product claims on behalf of Wal-Mart Stores, Inc., and its insurance company. We are very sorry to hear of your incident which involved a cantaloupe. At this time, we would like to share some information with you regarding the claims handling process. Upon reviewing your claim, Claims Management, Inc. sent the claim to the product supplier. Sol Group Marketing, to handle with you. Pursuant to the agreement between the supplier and Wal-Mart, the supplier or its insurance company will be responsible for the investigation and resolution of this claim with you. If you have any questions, feel free to contact me at Product Claims E-mail address: PROCLM@cmiw.com Sincerely, Angela Bingham Case Manager III How can Angela Bingham, who would not answer and return my calls and according to Cora Rodriguez waited two months to contact them, tell me, to please respond to the supplier’s request as soon as possible to ensure the prompt investigation and resolution of your claim. Wal-Mart should have recalled the cantaloupes on its own instead they no longer sells, the Fresh Quest Honduras or Guatemala cantaloupes in the store where I purchase the cantaloupes. The Contaminated Defective Cantaloupe’s were removed from the Wal-Mart Store, within weeks after my foodborne illness occurred. Wal-Mart replaced the Contaminated, Defective Honduras or Guatemala Cantaloupe’s with a variety of cantaloupes, such as Fisher Ranch Cantaloupes, Majesty Cantaloupes, Mini-Kiss and Santa Rosa Cantaloupes.

This fruit food should be move from the market. The Honduras or Guatemala Cantaloupes should have been voluntarily, recalled, by Wal-Mart and Fresh Quest. These cantaloupes are a health hazard. Continue use of these cantaloupes being sold to the public can cause a break out of adverse health consequences or even deaths especially to young children, the elderly and to pregnant women. By ingesting Fresh Quest cantaloupe caused me to be admitted into the emergency room. I was treated for Food Poisoning, also call Foodborne Illness, which could have resulted, (lead) to the death of me. Cantaloupe Brokers and all Parties including Wal-Mart are responsible for my sickness. I relied on Wal-Mart reputation. I don’t know the condition of Fresh Quest Cantaloupes in Honduras or Guatemala, which are being grown and prepared there and shipped into the United States. But what I do know is, I was infected with a food borne illness from Fresh Quest/Sol Group Marketing Cantaloupe that Wal-Mart sold in their Store.

In my opinion, knowing that Fresh Quest Cantaloupes were infected and Wal-Mart still didn’t warn the public, but they removed the Defective Contaminated Cantaloupes out of their stores is Deceptive, Misleading and Unfair to, their Customers. The public must be protected, which means Fresh Quest, Sol Group Marketing, Wal-Mart and all Retailers who sell these Cantaloupes must correct the problem or, issue a public alert. Again I say, after eating Fresh Quest, Sol Group Marketing, and Wal-Mart, contaminated cantaloupe, I had to be admitted into the Emergency Room for Foodborne Illness. You can link my Foodborne illness back to the cantaloupe not only from my symptoms, and diagnoses, but also from the cantaloupe pictures, the witness, who are my daughter Lajohnda James and the two Wal-Mart Managers, who obtain and verified the mold inside of the cantaloupe, on April 9, 2016.

The cantaloupe was defective. The defect of the Cantaloupe caused my illness. As a result of the defective cantaloupe I suffer damages. I have medical expenses. I suffered from emotional distress, pain and suffering and loss of quality of life. I have been made not to never ever eat another Cantaloupe for fear of getting Foodborne Illness, as well as fear of it, also causing my death.

Our cantaloupes are rigorously put through a Food Safety program which is lab-tested each and every day. When we spoke and per the information you provided Wal-Mart store No. 866, you stated you became ill following consumption of “unknowingly molded product.” As some background information to you, cantaloupe does not mold on the inside unless it has been opened. Mold is not a contaminant, but can form on the outside of an older melon when exposed to heat for a considerable time. This however remains on the outside. This is just some general information on cantaloupes and their shelf-life. Sol Group requested a copy of the pictures of the cantaloupe and your medical bills.
